The Ninth Circuit Court of Appeals has just ruled that President Donald Trump has the authority to send asylum seekers to Mexico as they wait for the United States to adjudicate their claims, handing the president a huge win on immigration policy.
Yep. Rub your eyes and pinch yourself. I did in fact say “NINTH CIRCUIT” — the most liberal appeals court in America. But not for long.
When Trump took office, only 6 of the justices on that court were appointed by Republicans. Now? A whopping 13 of 29. And when his current 3 nominees are confirmed by the U.S. Senate, the court will be deadlocked for the first time in 40 years. If Trump is re-elected, the court will be flipped conservative.
It seems that, despite the 9th’s still-liberal majority, the justices are tiring of constantly being reversed by the new aggressive Kavanaugh-Gorsuch Supreme Court, and may be throwing in the towel.
If so, Trump’s moves on the border may start to accelerate, benefitting all Americans.
The DC reports:
The “Remain in Mexico” policy seeks to curb catch-and-release by denying fraudulent asylum seekers the incentive of being released into the interior of the U.S. while their cases proceed in immigration courts.
The circuit court overruled an earlier decision by San Francisco Judge Richard Seeborg, who blocked Trump’s policy on the grounds that the administration was making the asylum process too difficult and could be putting migrants at further risk by demanding they stay in Mexico. The Ninth Circuit temporarily issued a stay in mid-April while they reviewed the case, allowing the Trump administration to continue the policy until further notice.
Now, the president can declare a major victory on “Remain in Mexico.”
The lower court still has to rule on the merits of the case, which could end up at the Supreme Court.
And on immigration, that SCOTUS is not the same as it was just 2 years ago, when centrist Anthony Kennedy routinely voted with the left on immigration, such as his opposition to Arizona’s 2010 law SB1070, against which Kennedy struck down 3 of 4 provisions.
Justice Brett Kavanaugh is a reliable immigration hawk, and has backed Trump on each of the two cases so far brought before the high court.
Meanwhile, the liberal media is freaking out over other tough moves Trump is making against fake “asylum seekers”:
The Washington Post obtained documents and emails from the White House on Tuesday that ordered asylum officers to be tougher with applicants, flagging inconsistencies in their claims about having credible fear in their home countries. President Trump has repeatedly accused some asylum seekers of being “coached” through their initial interviews with asylum officers and has made a concerted effort to eliminate fraud from the system.
As BorderPAC previously reported, Attorney General Bill Barr further advanced the administration’s crackdown on asylum seekers by deciding in April that such immigrants are not eligible to be released on bond.
They therefore can be detained indefinitely during the adjudication process unless the Department of Homeland Security (DHS) deems them eligible for parole for other reasons.
Between the Barr edict and the 9th Circuit’s new ruling, there are now two massive impediments to the tens of thousands in “caravans” who planned on using lax Obama-era rules to come right in.
The doors are finally closing to these economic opportunists posing as “refugees”. And it’s a beautiful thing.
